Alpha Tester Agreement

This agreement applies when you've been accepted as an alpha tester for one of our products. It sits alongside our Terms of Service and Privacy Policy, and adds a few alpha-specific points. If you don't agree, you can withdraw at any time — see section 6.
1. Who runs this
Alpha programs are operated by ATOMIRA TECHNOLOGIES, S.L. (CIF B27662717), registered office at Calle Lepant 270, 08013 Barcelona, Spain. For anything related to this agreement, contact hello@atomira.eu.
2. Pre-release nature of alpha products
Alpha products are software in active development. By participating in an alpha, you acknowledge that:
- features may change, break, or be removed without notice;
- data you create may not persist across releases — we'll warn you before destructive changes whenever possible, but not always;
- we do not guarantee uptime, performance, or that the software will be fit for any particular purpose;
- the product is provided to you as-is, with no warranties beyond what Spanish consumer protection law requires.
3. Your feedback
If you submit bug reports, feature requests, suggestions, or any other feedback to us during the alpha, you grant Atomira a non-exclusive, royalty-free, perpetual, worldwide licence to use that feedback to improve our products. We are not obliged to implement any specific request, compensate you for it, or credit you publicly (though we may, with consent — see the Founding-User credit benefit if it's part of your offer).
4. Confidentiality of unreleased features
Some features visible during the alpha haven't been announced publicly. We ask that you don't publicly disclose specific unreleased features without our consent. Your general impressions and reviews are fine — please share them. The line is: don't leak features-in-progress.
5. Your benefits
The specific benefits offered to you as an alpha tester — free access during the alpha, post-launch free or discounted periods, recognition credits, referral bonuses, contributor recognition — are described in the product offer at the time you accepted the alpha invitation. We will honour those benefits as described. They do not create a long-term commercial relationship beyond what is stated in the offer.
If we change the offer for future alpha cohorts, the benefits we promised when you joined still apply to you.
6. Ending the alpha relationship
You can stop participating at any time, without penalty — just let us know by email. Your account remains until you ask us to delete it. We can also end the alpha relationship at any time if we have to (e.g. if the product is discontinued, or if you significantly breach this agreement or the Terms of Service). If we end the alpha early for reasons unrelated to your conduct, the post-launch benefits you were promised still apply at the eventual public launch.
7. How we handle your data
How we handle data you create in alpha products — including drafts, references, uploads, and any personal data you enter — is described in our Privacy Policy. Briefly: it is stored on EU infrastructure, it is not shared with third-party AI providers when you use a product's privacy/in-browser AI mode, and you can request export or deletion at any time at hello@atomira.eu.
8. Governing law and disputes
This agreement is governed by Spanish law. Any disputes that cannot be resolved by direct communication will be heard by the courts of Barcelona, Spain.
9. Changes to this agreement
We may update this agreement to reflect changes in the alpha programs or in applicable law. We will notify alpha testers by email when we make material changes, and the date at the top of this page will be updated. Continued participation after a material change means you accept the updated agreement.
